Supreme Court Slams Karnataka High Court Over Bail to Actor Darshan in Murder Case
The Supreme Court of India on Thursday reserved its order in the Renukaswamy murder case, sharply criticising the Karnataka High Court for granting bail to Kannada actor Darshan and others accused in the case. The apex court described the High Court’s decision as a “perverse exercise of discretion” and questioned whether judicial mind was applied appropriately.
A bench led by Justice B.R. Gavai expressed deep concern over the manner in which bail was granted, stating, “We are sorry to say, but does the High Court dictate the same kind of orders in all bail applications?” The court noted that the serious nature of the murder and conspiracy charges demanded greater judicial scrutiny, which seemed lacking in the High Court’s order from December 13, 2024.
The Supreme Court also raised questions about the dismissal of crucial eyewitness testimonies by the High Court, and the presence of digital and forensic evidence corroborating the prosecution’s claims. Senior advocate Sidharth Luthra, representing the Karnataka government, submitted details of call records, location data, and disturbing photographs retrieved from the accused.
The court expressed disbelief over the accused allegedly posing for pictures during the assault, calling it “unbelievable.” The bench concluded by stating that while it would not decide on guilt or innocence, it would scrutinize the conduct of the High Court in the matter.
