Many of us are very well aware about the fundamental rights that each one of us has. But the rights don't just stop here. There is more to rights than just fundamental ones. So these below mentioned facts might just help you in being aware about them. RAPE VICTIM AND FIR FIR can be filed by a rape victim at any police station. This right is given under the Right to Zero FIR. It is not right to send away the victims just to stay away from the responsibility. Having this right in itself means that the police can't send the victim claiming that it does not fall under their area. VIRTUAL COMPLAINTS Did you even know that the women have the right to file virtual complaint if they cannot go to the police station. This complaint can be filed in the form of an email or a registered post addressing to the Commissioner of Police. The police then has to make sure that they reach the victim's residence and listen her out. RIGHT OF THE ARRESTED PERSON A person who has been arrested has the right to be presented before the judge within 24 hours. The police cannot detain him longer than 24 hours. This right falls under Article 22(1), and this article takes care of the preventive detention in India. LIVE-IN RELATIONSHIPS As alien as it may sound, but live-in reationships are not illegal in the country, which unfortunately not many landlords agree to. NO DISMISSAL OF RAPE CASE A rape case cannot be dismissed even when the doctor has said that the victim has not been raped. According to Section 164 A of the Criminal Procedure Code, the victim has to be medically examined. The doctor can only make a statement that there is a sign of recent sexual activity. If the victim has been raped or not, is a legal decision which the doctor can't decide. DIVORCE A married couple can only divorce each other after completing one year of their marriage. This is in accordance with Section 14 of the Hindu Marriage Act 1955. But if the person is experiencing trauma, then he may get divorced. GIRLS BEING ARRESTED A woman cannot be arrested after 6 PM and before 6 AM by a police officer, except when there is a woman officer present. In other cases if the police has a written permission from the Judicial Magistrate. POLICE OFFICER A police officer if refuses to file the complaint can be arrested and can even be put behind the bars. IDENTIFICATION OF COPS It is important for the police officers to wear complete identification. Even the interrogating officer has to wear his identification. EQUAL RIGHTS OF SONS & DAUGHTERS According to Hindu Succession Act made in 2005, the sons and the daughters have equal right to inheritance of the property.
