SC CANCELS CASE AGAINST PRIYA PRAKASH VARRIER'S WINKING SCENE

The Supreme Court has cancelled the criminal case against Priya Prakash Varrier, the Malyalam actress who enacted in a film titled 'Oru Adaar Love'. The court said that the case against the actress or the filmmakers will not be entertained just because of the song picturisation. Chief Justice Dipak Misra, who led a bench also muted the fresh complaints against the actress or the filmmakers under Section 295A od the Indian Penal Code. Under this section, any person who intentionally acts to insult or defame the sentiments of a religion or a religious group is punished. The court said, "Even if it’s (winking scene) true, it does not come within the ambit and sweep of section 295A." It also added that the emphasis in law is on the exaggerated form of insult to any religion, when it is performed with a malicious intention. The complainant only filed the FIR to gain mileage. The court said, "We do not perceive any calculated tendency adopted by the petitioners to insult or disturb the public order or invite the wrath of section 295A." This the court said while refusing the complainant's disagreement that the song picturisation hurt the sentiments of Muslims. Priya Prakash Varrier became an overnight sensation few days before Valentine's Day this year, because of a video in which she is seen winking at her co-star.
